Acceptable Use Policy

This Acceptable Use Policy (AUP) applies to everyone who uses AskFrankie, and forms part of the AskFrankie Terms of Service and each SaaS Subscription Agreement with [ENTITY NAME] (ABN [ABN]).

The short version: use AskFrankie lawfully, for your agency’s real business, with data you’re entitled to hold — and don’t try to break it.

1. You must

  • comply with all applicable laws, including the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), the Australian Consumer Law, and real-estate legislation applying to your agency (for Victorian agencies, including the Estate Agents Act 1980 (Vic) and Sale of Land Act 1962 (Vic));
  • only enter personal information you have lawfully collected and are entitled to hold;
  • keep your login credentials secure and not share individual accounts;
  • review AI-generated content before relying on it or sending it to clients.

2. You must not

Unlawful or harmful use

  • use the Service for any unlawful, misleading, or deceptive purpose — including preparing misleading price representations (underquoting) or misleading advertising;
  • use the Service to harass, defame, discriminate against, or harm any person;
  • send spam or marketing messages that breach the Spam Act 2003 (Cth) or Do Not Call obligations.

Data misuse

  • upload data you have no right to hold (for example, records scraped or taken from another agency without authority);
  • enter sensitive information (health, ethnicity, and similar) into free-text fields without a lawful basis;
  • attempt to access another agency’s instance or another user’s data beyond your authorised role.

Technical abuse

  • probe, scan, or test the vulnerability of the Service, or bypass authentication or access controls;
  • introduce malware, or interfere with or disrupt the Service or its infrastructure;
  • place unreasonable load on the Service (for example automated bulk scraping outside supported features);
  • reverse engineer, copy, or resell the Service, or use it to build a competing product;
  • use AI features to generate malicious code, or attempt to extract other customers’ data or the Service’s system prompts or credentials.

3. Integrations

If you connect a third-party service (such as Rex Software or Microsoft Outlook), you must have the right to do so under your agreement with that provider, and your use of the integration must comply with that provider’s terms as well as this AUP.

4. What happens if this policy is breached

We may, acting reasonably and proportionately to the breach:

  • warn you and ask you to remedy the issue;
  • suspend affected accounts or features while we investigate;
  • terminate access for serious or repeated breaches, in accordance with your agreement.

Where a breach involves unlawful activity, we may also be required to notify authorities.

5. Reporting

To report abuse, a security vulnerability, or suspected unauthorised access, contact [security@askfrankie.com.au]. We appreciate responsible disclosure and will not take action against good-faith security research conducted without harming the Service or customer data.
